Inner Bliss CORP Terms of Use

These Terms of Use (“Terms”) are between Inner Bliss Corp and “You”, the person using Inner Bliss Corp  products, materials, web site and Customer Service Department (“Services”). By using the Services you accept the Terms. Inner Bliss Company may at any time revise these Terms of Use by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the then current Terms of Use. The term “Affiliates” as used in this Terms of Use Policy refers to related companies or brands.

IMPORTANT: THIS AGREEMENT CONTAINS A MANDATORY ARBITRATION PROVISION. BY AGREEING TO THESE TERMS OF USE, YOU ACCEPT THAT YOU MUST RESOLVE ANY CLAIM THAT YOU MAY HAVE AGAINST THE COMPANY ON AN INDIVIDUAL BASIS IN ARBITRATION, AS DESCRIBED IN MORE DETAIL BELOW IN THE DISPUTES SECTION.THIS WILL PRECLUDE YOU FROM BRINGING ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION AGAINST THE COMPANY. IT ALSO WILL PRECLUDE YOU FROM PARTICIPATING IN, OR RECOVERING RELIEF UNDER, ANY CURRENT OR FUTURE CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION BROUGHT AGAINST THE COMPANY BY SOMEONE ELSE.

Terms of Purchase

The Services allow you to purchase products or services. To purchase any products or services through the Services, you must: (a) be at least eighteen years of age, (b) provide us with valid payment information associated with a credit card or other payment method that you are authorized to use, and (c) authorize us to charge your credit card or other payment method for the price of the products or services that you request, together with any taxes, fees, or shipping charges described on the Services.

In offering product descriptions on the Services, we attempt to be accurate, but we do not warrant that any product description is accurate, complete, or error-free, nor do we represent that any product will diagnose, treat, cure, or prevent any disease. In particular, please note that we may carry products from third-party sellers, and we rely on these sellers to provide descriptions of their own products. If you receive a product and believe that it materially differs from the product description, your sole remedy will be to return the product to us for a refund in conformance with the return policy listed on the Services. Likewise, we attempt to list the current price for each product that we sell, but a small number of products may be mispriced. In these cases, we will notify you before shipping the product of the corrected price and will either cancel your order or give you an opportunity to cancel your order or decide to keep your order.

Online Product Purchases

(a) Product Purchases. You may purchase products available on the Site. All products, specifications, descriptions, and prices are subject to change at any time without notice. Your purchase is subject to these Site Terms of Service and the Privacy Policy. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order.  In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.  

(b) Payment Information. You will be asked to enter your payment details during the checkout process. By placing an order, you confirm that the credit card you use is yours. All card payments are subject to authorization by your card issuer.

(c) Shipping. Products you purchase through the Site will be shipped to you at the address you designate as the shipping address during the check-out process. We are not responsible for any packages that are refused or held for delivery. Refunds will not be issued for any orders that are refused by intended recipient or that cannot be delivered to due to an address error.  Currently, our Products are only available for purchase by residents of the 50 United States and the District of Columbia, and will only be shipped within the 50 United States and the District of Columbia. 

(d) Return Policy. If you are not satisfied with your purchase for any reason, you may return it within 14 days of the date of your purchase for a full refund, excluding any shipping charges.  Please keep your packing slip or confirmation email for proof of purchase. We monitor return activity for abuse and reserve the right to limit or refuse returns or exchanges.

However, it is important to note that we cannot accept returns or issue refunds for products that arrive with damaged packaging or are defective.

We reserve the right to request the product be shipped back to us in its original packaging at the customer’s expense and we do not assume responsibility for lost or misdirected returns. Please note that clearance items, as well as short-dated and expired product are not eligible for an exchange or refund.

Subscribe & Save

When you purchase a subscription you will regularly receive repeat deliveries. These are based on the subscription duration and frequency that you select. Your recurring subscription(s) will remain active until either you or Inner Bliss Corp decides to cancel. You or Inner Bliss Corp can terminate any recurring subscription at any time, and there will be no cancellation fee or ongoing charges after cancellation, except if a shipment in a recurring subscription has already been processed before cancellation. In such a case, the recurring subscription shipment will be canceled after that specific shipment, and you will be responsible for the payment of the last shipment.

Your payment details will be stored, and you'll be charged for each of these deliveries at your specific frequency.

If you want to cancel or change your subscription, you can do it at any time. Your order confirmation emails have links to your order. 

 Upon cancellation, your account created or registered with us (referred to as your "Account") will not be deleted, and you can still access your Account.

At the time of purchase, you may have been offered discounts based on the total purchase price for the Service. The Fee for the Service (which does not include applicable sales tax) was stated to you at the time of purchase. The Fee is charged on the shipping date and is charged to the credit card you provide at the time of purchase.

If you use a credit card, you may be subject to a preauthorization at the time you place your order. The preauthorization is not a charge to the credit card. However, the then applicable Services may be reserved against your available credit card limit, including taxes, if any. Contact your credit card issuing financial institution for details.

No Professional Advice or Medical Information

The Services do not provide medical advice, diagnosis or treatment, and the information included on the Services is offered for informational purposes only. Some portions of the Services may allow you to submit questions either to us or to third parties who have agreed to communicate with our users. Although we provide information about our products through the Services, neither our employees nor these third parties are authorized to provide medical or other professional advice through the Services. We also have not confirmed the qualifications of any third party who provides information through the Services, even if that third party lists his or her qualifications. As a result, you should never use the information you obtain on the Services for diagnosis or treatment of any health problem or in place of any medication or other treatment prescribed by a physician or other healthcare provider.

Please consult with your physician or other healthcare provider if you have health-related questions before using any of our products or relying on any information you obtain on the Services. Modification of Service

Inner Bliss Corp reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. You agree that Inner Bliss Corp shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Services.

Limitations

The Services are limited to individuals 18 years and older. Your order is solely for personal use and not for re-distribution. You agree that you will not access, reproduce, duplicate, copy, sell, resell or exploit for any commercial purpose, the Services or any portion thereof. Inner Bliss Corp will not be liable for any loss or damage arising from such activities, and Inner Bliss Corpreserves the right to terminate access to the Services, with or without notice.

Use of Information and Ideas Submitted

You hereby acknowledge and agree that Inner Bliss Corp is free to use any comments, information, ideas, concepts, reviews, techniques or other information contained in any communication you may send to Inner Bliss Corpor any communication you may have with an Inner Bliss Corp representative (the “Ideas”), and Inner Bliss Corp shall have no obligation to compensate you in any way for the Ideas, even if the Ideas are used by Inner Bliss Corp for commercial purposes, including but not limited to use by Inner Bliss Corp for developing, manufacturing and marketing products and creating, modifying or improving Inner Bliss Corp products or other products, services or websites affiliated with Irwin Naturals. Furthermore, by posting or displaying any such Ideas on our site, you hereby grant to us a nonexclusive, royalty-free license to display, use, reproduce and/or modify the Ideas.

Disclaimer of Warranties

You expressly understand and agree that your use of the Services is at your sole risk. The Services are provided on an “as is” and “as available” basis. Inner Bliss Corpexpressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Inner Bliss Corp makes no warranty that (i) the Services will meet your requirements, (ii) the results that may be obtained from the use of the Services by other Customers will be accurate or reliable, and (iii) the quality of any products, services, information, or other material purchased or obtained by you through the Services will meet your expectations.

No advice or information, whether oral or written, obtained by you from Inner Bliss Corp through the Services shall create any warranty not expressly stated in the Terms of Use.

Your use of the Services is at your sole risk. The Services are provided on an "as is" and "as available" basis. We reserve the right to restrict or terminate your access to the Services or any feature or part thereof at any time. We expressly disclaim all warranties of any kind, whether express or implied, including the implied warranties of merchantability and fitness for a particular purpose and any warranties that materials on the Services are non-infringing, as well as warranties implied from a course of performance or course of dealing; that access to the Services will be uninterrupted or error-free; that the Services will be secure; that the Services or the servers that makes the Services available will be virus-free or otherwise free of harmful components; or that information on the Services will be complete, accurate or timely. Inner Bliss Corpis not liable for ANY damages of ANY kind that result from use of the Services. This applies to alleged liability on ANY basis, even if Inner Bliss Corphas been advised of the possibility of such damage.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. In such jurisdictions Inner Bliss liability, if any, shall be limited to the extent permitted by law.

Indemnification

Upon a request by Inner Bliss Corp you agree to defend, indemnify, and hold harmless Inner Bliss Corp. and its affiliates, and their employees, contractors, agents, representatives, officers and directors from all liabilities, claims, and expenses, including without limitation attorneys’ fees that arise from your use or misuse of this site. Inner Bliss Corp reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Inner Bliss Corp in asserting any available defenses.

Choice of Law and Forum

These Terms are governed by laws and regulations of the State of Florida. Any action to enforce or interpret them shall be brought and maintained exclusively in the Superior Court of the State of Florida or the U.S. District Court in Florida. The parties irrevocably submit to the jurisdiction of said courts and waive all objections thereto.

Severability and Integration

Unless otherwise specified herein, these Terms of Use and the Privacy Policy constitute the entire agreement between you and Inner Bliss Corp and its Affiliates with respect to this site and the Services and supersedes all prior or contemporaneous communications and proposals (whether oral, written, or electronic) between you and Inner Bliss Corp with respect to the Services. If any part of these Terms of Use or the Privacy Policy is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.

Community Decency Policy

This policy applies to all content on the Inner Bliss Corp website (“Website”), www.innerblisshop.com, but specifically shall be applied to all customer reviews or other third-party generated content (“TGC”) that is posted to the Website.

TGC will be removed if it falls into the following categories:

• Vulgar or obscene language such as cursing
  
• Defamatory, derogatory, or inflammatory content
  
• Information or images that are considered or imply illegal conduct

The terms “law” and “laws” means statutes, common law, regulations, rules, ordinances, treaties, and the like, including governmental proclamations and orders and court orders that have the effect or force of law, and when referring to remedies includes both damages and equitable remedies. Except as otherwise specifically stated in this Agreement, “days” means calendar days.
